Industrial property rights (IPR) are of paramount importance in the context of the emphasis placed by the European Union (EU) on promoting innovation and competitiveness to drive economic growth. They cover both technological rights (including patents, utility models and supplementary protection certificates) and commercial rights (including trademarks, logos, designs, appellations of origin and geographical indications) and can be used as a strategic tool for brands and companies in various industries.

Among their many benefits, IPRs can help differentiate a company from its competitors, provide a strong revenue stream, increase the value of the company and even help with the marketing strategy. But their role goes further. As exclusive economic exploitation rights, they can ultimately help strengthen the EU’s position in international trade negotiations and agreements. That is why the European Commission has implemented a series of directives and regulations to harmonise industrial property laws in all Member States, simplify legal procedures and increase legal certainty for businesses operating in the EU.

Despite existing national and European complexities, a single application can streamline industrial property protection across the EU. A good understanding of this tool, therefore, empowers companies and brands to extend their market reach. With this in mind, this document aims to clarify key concepts, highlight the importance of the issue and provide guidance for companies considering registering intellectual property rights in the EU.
